Conditions of Use
- In General
1.1 The Homepage www.pairs.ch is an online shop (afterwards called Pairs)
1.2 The orders are going to be entered trough internet and the confirmations sent by email.
1.3 The terms and.conditions are governed by the laws of Switzerland.
1.4 The company Head Office of Pairs GmbH is: Pünt 2, 8185 Winkel
1.5 The terms and conditions mentioned below govern any use or affair in relation with the homepage www.pairs.ch
1.6 Exclusively these Terms and Conditions are going to be used.
- Data Privacy
2.1 Pairs is treating customer data confidential and according data privacy law.
2.2 Pairs is not handing out nor selling any customer data (Name, Address, Email etc.) or other personally data to a 3rd party.
- Scope of services of Pairs Online Shop
3.1 Pairs is an online shop and works after the traditionally understanding.
3.2 Business process Pairs: Customer gets its information and orders trough internet. Pairs is providing an order confirmation via email to the customer. The payment need to be carried out in form of creditcards, debitcards, downpayment or bank transfer. After receipt of payment the goods are going to be delivered in the time agreed.
3.3 The offers on Pairs are without commitment. A contract between a customer and Pairs comes about with an order of the customer made online and the acceptance of Pairs sent by email.
- Delivery/Transport
4.1 The delivery of the goods are taking place within a week after payment receipt. Our courier is transporting your goods ex warehouse to your requested delivery address. For delays in the delivery caused by our supplier or courier, Pairs is not taking any responsibility for.
4.2 All deliveries are carried out trough our co-contractor Geizkurier. The exact day of arrival cannot be forecasted.
4.3 Normally all orders are going to be fully shipped. Partial deliveries are occurring when goods are not deliverable ex warehouse. The delivery costs for the partial delivery are paid by Pairs. The customer are going to be informed by email.
4.4 You are going to be informed by email if a delay in delivery occurs.
- Transportation Costs
5.1 Per email the customer receives order confirmation and a binding invoice including the delivery costs
5.2 Orders up to CHF 200.- the delivery costs are CHF 8.90
5.3 Orders over CHF 200.- the delivery costs are for free.
- Payment Conditions
6.1 Normally the payment are executed after the order has been placed online. The offered payment methods are: Creditcards, Debitcards, bank or post transfers.
6.2 The goods are property of Pairs and no delivery will be executed until full payment has been received.
6.3 The payment is due within 5 working days. If a payment is overdue than the customer will be notified by email.
6.4 Takes no payment place than we are referring to article 8.1.
6.5 The Customer takes notice if the payment is overdue that Pairs is charging 5% late interest and a dunning fee of CHF 20.00. Previously given discounts are going to be anullated.
- Prices and Discounts
7.1 Price –and discount levels could be changed anytime without any advance notice.
7.2 All invoicing carried out in Swiss Francs (CHF).
- Default of Acceptance respectively Denial
8.1 When the customer is not paying within the term set, is refusing the delivery or declares to decline the order, than Pairs has the right to decline completion of contract and ask for damages because of failure to perform a contract. The damage is due for the due amount with an addition of 20%.
8.2 Due amounts need to be paid to our bank account within 10 days.
8.3 If the customer is fallen behind with the payment than Pairs will set a new term of 10 days in a dunning letter. Should the term end without the payment Pairs will institute the enforcement without announcement.
- Credit standing
9.1 We will decline orders, if the customer is not creditworthy, the address cannot be checked, overdue invoices are unpaid or we have suspicion the order has been placed with circumventive purpose.
9.2 Pairs has the right to decline orders without to declare a reason.
- Return/Exchange
10.1 If the article is defective or damaged they need to be returned immediately to Pairs. You are going to receive either an exchange of the same article or the invested amount as a voucher as soon the defective or damaged article is in property of Pairs.
10.2 The customer can exchange shoes, who are not fitting. The customer needs to inform Pairs the article to be returned within 5 working days to returns@pairs.ch. No returns or exchange possible if the shoes were worn or damaged. The exchange is only possible for the same article.
10.3 Pairs can decline returns if the goods are not returned in the orginal box or are damaged. In such cases the shoes will be invoiced including transportation costs.
10.4 If Pairs is not informed of a return by email or a letter together with the return, than the return is not going to be handled.
10.5 No payment will take place for goods return. Customer will receive vouchers which can be used in the Shop.
- Declaration of Liability
11.1 Pairs declines any liability for links of external sites regarding their content, layouts or political interests. The customer has to inform Pairs about dubiously sites immediately.
11.2 For technical problems as well partial –or full lost of homepage and customer data, Pairs will decline any liability. The homepage can be changed with regards to content or in the layout at anytime.
- Right of withdrawal
12.1 Customers have the right to withdrawal from the contract without to declare a reason if payments made by credit card. The goods need to be returned in the original box and in good order and condition within 7 days to Pairs. We will refund you for the goods but not for the transportation costs.
- Final clause
13.1 Should there be single or several rules effectless of this terms and conditions of use, than the effectiveness of the remaining rules are not going to be touched. The effectless rules are than replaced by legal regulation.
13.2 Business activity is exclusively governed by Swiss law. Place of jurisdiction is district court in 8180 Bülach.
13.3 Branding and layout of Pairs are under supervision of the patent law. Any usage of pictures, wordings are strictly forbidden or need to be approved by Pairs.
